Dead end job? Get a grant for going back to school

The reason I am including this today is that the unemployment rate is contributing to the massive loss of homes. Sincerely believing that the foreclosure waves are not over means that we have to do all we can to help insure our futures.

In the past people could do well even without a degree, now it is harder than it was even 10 years ago to make up the difference in payscales. If first jobs are hard to come by - pity the person needing a second job to make ends meet.

For those just out of High School, consider these things as you choose what you do over the next few months. For those of us that are restructuring work life and our financial future - I hope this helps.

Today Congress let go of extended unemployment benefits, which will further harm Americans that are out of work and barely holding on to their homes. I only hope this is not how they are paying for healthcare insurance.

Most of those homeowners were rejected during a trial period lasting at least three months. More than 6,300 dropped out after having their loans modified.



What did I tell you Saturday??? My realtor friends seems to be on the right side of the wave. If you aren't in foreclosure but are nearing a deliquency or are deliquent, start seeking help early.

Evictions on Father's Day? Foreclosures newest low

Today, we feel fortunate! We are still in our home of almost 10 years and can celebrate one more Father's Day in our home. I wonder about other's as we were served our summons on Memorial Day.

A DAY OFF FROM WORRY????

My mind as I wake up has a fleeting moment of wonder: "Are there Father's out there receiving a knock on the door by the Sheriff's Deputy?" Do eviction notices, forcible detainer summons and other unpleasant things get served on Father's DAY??? I spend a few minutes pondering and the imaginative results of that question are so unpleasant, I jump out of bed to distract myself by making coffee. Unfortunately the thought haunts me, so I decide on FATHER'S DAY to craft a blogpost about it.

I hope not. If it is were summons to pay back child support that would be fitting but to be evicted from your home, or summoned to court in a forcible detainer action (eviction NOTICE) would be ultimately inhumane in my opinion and there must be humaneness somewhere.

For us we are spending most of day learning about how to fight foreclosure with friends, learning laws and procedures from JurisDictionary and updating our documentations notebook.

Happy Father's Day to my Dads and to my Honey!

We are celebrating this morning with coffee and phone calls to our family and then tomorrow, when all the kids are off work, we are having our get together. I rue the day that I ever wished retail and restaurants to be open on Sunday. ")

I have read that the banks stopped many foreclosure proceedings over the Christmas and NewYear's Holidays in 2009. But having had our SUMMONS served on Memorial Day, my mind wanders to today - Father's Day. WE are safe from the door knock becauase we are not being summoned and writs are issued Monday through Friday.

Not much to link to in news with short time on the weekend.. BUT WATCH for news about the FBI / Obama sweeps for bank fraud. Basically making fraud mortgages go back to originator if I heard the news correctly.

FANNIE MAE and FREDDIE are now OFF the stock exchange. 5 -10 years ago they were hot investment stock and now they are deader than a doornail for investing.

My Realtor friends say to watch for HUGE fall out with new avalanche of mortgages. One of my Realtor friends feels the banks are just holding back on some foreclosures. YOU tell us what you think................

Know the Laws to Save Your Home

One thing in our journey that has become apparent, is that what you don't know - can indeed HURT you. at the very least lack of knowledge will slow you down. Learn the laws before you need them. Learn the laws as you need them. But whatever you do, learn the law. It will help you, even if you decided to hire a lawyer.

If you have not faced foreclosure yet you may want to start looking at TILA and RESPA, OR FDPCA laws. If you are delinquent now, or been served a notice of intent to foreclose then start looking at your state's laws and regulations.

IN our state there are laws broken in the process of foreclosure that are common. You can address these before a trustee sale. You need to start documenting everything you can. Here is the link to the AZ Legislature page which has much information including a link to the ARS aka: Arizona Revised Statutes

One MUST READ statute is the one for 33-808. Notice of trustee's sale:

Foreclosure, Short Sales, Strategic Walkaway: It all hurts everyone!

Today, Neil Garfield had GREAT post that is confirming what I have been pondered for months. Housing modification loans MUST start reflecting drops to fair market value(FMV).

In my never to be humble opinion, ALL Loans should be immediately adjusted to reflect FMV without making any mortgagee jump though loopholes to make right the payment structure. Call me radical but I go further than most - I don't think one single person in America should have take hours to fill out new paperwork, submit - get rejected, play games and wait a year for a modification. Just fix the paperwork at the bank and assign new value, payment etc. Let homeowner sign it if they like or go to the table to negotiate. Lower everyone's payments fast for every single homeowner in America! A girl can dream!

As Neil indicated it is not a gift to address the fair market value in modification process. Strategic walkaways are not only a trend but many bankers I've talked to seem to see nothing wrong with it. The current situation is going to cause ALL HOME VALUES to drop, in my opinion. And increase walkaways and short sales and possibly more foreclosures as homeowners previously treading water are now drowned with the banks holding their heads underwater.

It concerns me that socially we "accept" strategic walkaways, shortsales , forced bankruptcies and yet do nothing to really address the homeowners that want to salvage their homes. Isn't it ironic that the banks are shortselling to about 1/4 of the value of the home when a homeowner is willing to pay off the home eventually?

Housing Market Slows as Buyers Get Picky

Editor’s Note: Housing prices will continue to decline until median income starts to flatten out. All signs indicate that we are in for another 10%-20% drop as conventionally measured. Remember that housing prices do NOT take into consideration selling expenses and concessions at closing. All things considered, housing prices should be at least 8% under what is reported.

With that 8% reduction, more homes are underwater than what has been reported. In fact, more homes are underwater than what their owners think they are.

How to find MORTGAGE and LOAN Fraud

Do you wonder if you have loan fraud?
Get out those closing documents!

1) Loan Rescission Notice - Many loans in 2006 did not receive copies of this important notice. If there is more than one person on the loan, each party is to have received a copy.

2) TILA law violations - TILA is the Truth In Lending Act check the link for laws and compare to your documents. You may want to pay for a forensic audit. If you need an audit email me alrady40@yahoo.com and I can refer you to reliable auditor. Did you know that if your loan closed less than 3 years ago you can rescind your loan fairly easily?????? A sister law to this is FDCA, Fair Debt Collections Act.

3) Amounts owing are in error or do not add up. A difference of just 65 bucks makes a HUGE difference and is a red flag to challenge the loan.

4) HOEPA I just recently learned about is that loans under 150,000 or interest rates of 8% or more, or points and fees in excess of $583 are red flags. This can be in violation of HOEPA,Home Ownership and Equity Protection Act. Many self employed people were given higher interest rates. We had a high rate but it did not qualify. FTC-HELP (1-877-382-4357); TTY: 1-866-653-4261.

DO You Need Help Reading Your Documents?

If you want a forensic audit you can have one done free through NACA.com. I have not used them and cannot vouch for how well they perform. I do have a forensic auditor I recommend to those that email me. The cost is reasonable and probably less than you pay for one months mortgage.

Finding fraud can help to fight foreclosure, save your home and give you the ammunition to modify that loan to benefit you and not the bank.

    This is great news for us that were hit hard by BAC. We were assessed excessive fees for drive by appraisels and they threatened property inspection by entrance to home on notice that property was vacant. Do they just MAKEUP facts? I wonder what they would have had to pay if they had not settled for 108,000,000. It sounds like a lot but is not much considering the accusations read around the net of fraud. Are the avoiding distration as it says? or something more sinister?

    Bank of America to Pay $108 Million in Countrywide Case

    WASHINGTON (AP) — Bank of America will pay $108 million to settle federal charges that Countrywide Financial Corporation, which it acquired nearly two years ago, collected outsized fees from about 200,000 borrowers facing foreclosure.
    The Federal Trade Commission announced the settlement Monday and said the money would be used to reimburse borrowers.
    Bank of America purchased Countrywide in July 2008. FTC officials emphasized the actions in the case took place before the acquisition.
    The bank said it agreed to the settlement “to avoid the expense and distraction associated with litigating the case,” which also resolves litigation by bankruptcy trustees. “The settlement allows us to put all of these matters behind us,” the company said.
    Countrywide hit the borrowers who were behind on their mortgages with fees of several thousand dollars at times, the agency said. The fees were for services like property inspections and landscaping.
    Countrywide created subsidiaries to hire vendors, which marked up the price for such services, the agency said. The company “earned substantial profits by funneling default-related services through subsidiaries that it created solely to generate revenue,” the agency said in a news release.
    The agency also alleged that Countrywide made false claims to borrowers in bankruptcy about the amount owed or the size of their loans and failed to tell those borrowers about fees or other charges.

Because this is so important and INCREDIBLE - I am simply providing an introduction below this paragraph, to the blog that brought it to my attention.     WE Live in a Fishbowl - Moving without leaving

When my neighbor was foreclosed I did not feel it.....we didn't talk. All I knew was one day they were there - the next they were gone. It seemed to happen fast.

    Okay if the title doesn't make sense, it is because I am tired, tired, tired. We are mostly moved out and took the curtains and blinds. That means we are living in a FISHBOWL. At our place we have lots of LARGE WINDOWS that allow nighttime viewing.

    During the day the screens allow us to peer out without being watched by anyone. NOW LIFE, is

    full circle.When we moved here, there were no blinds. We bought paper blinds, because at dinner time the sun BLINDED me as I cooked dinner. I actually wore sunglasses to cook!

    WE have moved almost everything out that we don't need for just a couple of days survival. One skillet, one pot, and paper/plastic for the kitchen. One bed, no dressers or nightstands. TV and computers stay; what does that say about my priorities?

    Life On The Farm

    We still have the three golden retreivers, Ms. Barker, Ms. Bird Chaser and Mr. Mellow. They will be missing this golden acre of land when they are rehomed. Two goldens are going to temporary housing with friends, and one is coming with us. The dogs are my daughter's and she will not be able to have any of them with her. They have been her best friend's for 6 years. Hopefully we will be able to re-home ourselves in a couple of months.

    Things that change and a CALL TO ACTION

    For instance: Where do you put the extra car that when you get the money will save your bacon when the current car breaks down? Do you just lose out? Do you stick around waiting for the sheriff, the courts or the bank to make motions on your letters; or do you just keep moving your stuff.

    Do you rent a bulldozer to tear down that tree that you planted and has FINALLY become large enough for shade. After 3 previous plantings, it’s finally high enough that you don’t’ have to duck when you mow under it!

    Where do you go if your credit and income are trashed? Do you sue the people that didn't pay you rent, or pay you income? Each decision has a loop that plays mind and in your decision making every day.

    What about schooling? Pets? Paperwork? Address changes. For some the address change will be a PO box because they are going to live in the forest, in their car or in a garage. People of America it is time to stand up and say enough is enough. The government bailouts did not help people, banks and courts are shutting people down and it affects ALL of society. Your property values and local crime rates are affected by this debacle.

    We have not received a sheriff's notice yet, although it is recorded that judgement for eviction was upheld despite our pleadings. WE have one document left in the system that the judge did not rule on. We are prepared to fight further if we have to.

    Our temporary digs are in place, we are cleaning and situating for the eventual, inevitable move, as we move some of our things to the new “haunts”. The place is tiny and so we have things in storage and a daughter moving in with family members. All of this takes time. Of course once the sheriff shows up, I will not fight guns, ‘ya know? WE will keep you posted. For now, living in a fishbowl is an adventure and a good reminder of the need to keep light. All said and done, I am optimistic, God always takes care of us and the future looks better than the past.
