This weekend via John Stewart, Debbie Dobson and Beth Findsen - I received this email that referenced SB1259. It is important legislation that will help homeowners, and our Arizona courts, and economy. Families will be helped and possibly allowed to stay together rather than being split up, due to rushed non-judicial trustee sales done while modifications are in process. Take 5 minutes to let your reps/senators know that tyour thoughts on this bill EMAIL and/or CALL. Thank you to the people that have worked on this.
I DO WANT TO ADD THIS: Two foreclosure experts have emailed to mention that this billl as stands is NOT good. The bill idea is good but it includes a SUMMARY that will allow banks to be held to lower standard than law now allows. It will make it more difficult for those fighting for foreclosure to hold banks accountable for wrongful actions. I>E> A sale is void if it does not follow noticing procedures - that must not be done away with- it is part of contract law. A summary is just not good for foreclosure defense.
SB 1259, which would require the recording of a certification regarding the complete chain of title prior to any non-judicial foreclosure not conducted by an originating lender, or the sale would be voidable. Attorneys fees would be awarded if a homeowner had to sue to enforce this. THE BANKS HAVE ALREADY TRIED TO KILL IT BUT DID NOT SUCCEED THANKS TO MICHELE REAGAN – please thank her personally!
People need to support this bill and make sure that foreclosures are done properly and not without standing... give homeowners the ability to fight wrongful foreclosures without heaping up huge legal fees that the banks create.
