Bank of America Settlement Faces Growing Challenges - NYTimes.com: "In a separate new case, U.S. Bancorp, the trustee of a $1.75 billion mortgage pool originated by Countrywide Financial in 2005, sued to force Bank of America to buy back the underlying mortgages, arguing that the loans were made without proper documents and did not conform to underwriting standards.

“Soon after being sold to the trust, Countrywide’s loans began to become delinquent and default at a startling rate,” the complaint, filed Monday by U.S. Bancorp, said. “During the time period in which Countrywide originated the loans, it completely ignored its underwriting guidelines.” Bank of America acquired Countrywide, a subprime lending giant, in 2008.

The courtroom maneuvering on both fronts underscores the legal threats looming over Bank of America as a result of the collapse of the housing bubble and the disastrous acquisition of Countrywide, a $4 billion purchase that has already cost the bank more than $30 billion."

Our favorite foreclosure defense judge really seems fair with day to day litigation! One would think that Costco would rather just settle up than to pursue this.  It seems biz's have the advantage with the ability to pay for lawyers etc.    Congrats Judge Shack for leveling the playing field.

Judge deals Costco setback in 'slurpee' lawsuit - Business - Retail - msnbc.com: ""The court, in balancing the interests of plaintiff Danza against financial 'goliath' defendant Costco, holds that it would not be in the interest of substantial justice to try this action in Florida instead of New York," Shack wrote.
A Costco spokeswoman declined to comment, citing a company policy not to discuss litigation.
Pursuing the case at home could avert more pain for Danza.
"I do not intend to be traveling to Florida in winter anymore as traveling is too painful and stressful for me," she said in court papers quoted by Schack.
The case is Danza v. Costco Wholesale Corp, New York State Supreme Court, Kings County, No. 31512/2010."

This is no different than the hell people went through trying to achieve modifications that took over a year sometimes two years with failure, or those that modified only to have bank sell home (and whoops, its too late to fight a sale.)

In the case of the Barnetts, they promptly notified Chase, their servicer, and made one mortgage payment post the fire. Both the homeowners and the insurer, State Farm, called Chase to get a ten day payoff amount. They were told not to make the next payment, since it would be included in the payoff amount. State Farm sent as check as instructed, asked that the mortgage be paid off, and Chase cashed the check.

But Chase did not pay off the mortgage. It put the funds in a suspense account The Barnetts found out the mortgage had not been paid off on their own, and called Chase to get the matter corrected. Chase then proceeded to harass the Barnetts for payment, calling at home and at work. Chase then ‘fessed up that they had the money, and asked the wife, April, to send a fax instructing them to make the payoff. They didn’t, called to pressure her again, and claimed......" Bombshell Admission of Failed Securitization Process in American Home Mortgage Servicing/LPS Lawsuit « naked capitalism: "HMSI is a servicer (the successor to Option One, and it may also still have some Ameriquest servicing). AHMSI is mad at LPS because LPS was supposed to prepare certain types of documentation AHMSI used in foreclosures. AHMSI authorized the use of certain designated staffers signing with the authority of AHSI (what we call robosinging, since the people signing these documents didn’t have personal knowledge, which is required if any of the documents were affidavits). But it did not authorize the use of surrogate signers, which were (I kid you not) people hired to forge the signatures of robosigners.

The $5 billion sale of preferred equity, which initially sent the shares up 26 percent, may improve investor perceptions without meaningfully affecting the source of their concern, the bank’s capital, according to analysts including William Tanona at UBS AG. The deal gives Buffett’s Berkshire Hathaway Inc. (BRK/A) warrants that could make it the lender’s largest stockholder."

Buffett invests $5 billion in Bank of America - Yahoo! News: "Buffett said in a statement Thursday he called Bank of America's CEO Moynihan to ask about investing because he considered the bank a strong, well-led company.
Berkshire will receive a dividend of 6 percent on his investment in Bank of America. Berkshire will get 50,000 preferred shares and warrants to purchase 700 million shares of common stock at $7.14 per share. Buffett can exercise the warrants at any time in the next 10 years. If he does, it would make him the banks largest shareholder with a stake of 7 percent.
An hour after the deal was announced, Buffett had already made a profit on paper of $500 million on the stock warrants thanks to a surge in Bank of America's stock price. After closing at $6.99 Wednesday, the stock jumped 87 cents or 12 percent to $7.86 Thursday. Bank of America's stock traded as high as $15 in January, before its mortgage woes worsened."

US makes criminals priority for deportation - CBS5 - KPHO - Phoenix News, Weather and Sports: Homeland Security Secretary Janet Napolitano announced Thursday that the department will focus on deporting illegal immigrants who are criminals or pose a threat to national security or public safety.

Napolitano announced the plan in a letter to a group of senators who support revamping the immigration system. Under the change, approximately 300,000 deportation cases pending in immigration court will be reviewed case by case.

'It's a tale of two cities,' said Jason Ware, equity analyst at Albion Financial Group. 'You have one that looks like it's starting to make money, and then you have this mortgage business that is still throwing off pretty large losses.'

He and other analysts also said Bank of America is not likely to raise its skinny penny-a-share dividend until at least 2012.
