Colorado public trustees pushed to make it easier to foreclose on homes - The Denver Post: "Michael and Ann Rudnick wanted to know that Bank of America was really entitled to foreclose on their Denver home.

After all, the couple had borrowed $265,000 from New Century Mortgage in late 2006, yet it was Bank of America foreclosing three years later.

"They simply wanted to know how Bank of America came to have their mortgage, but they couldn't find out during the foreclosure," said Steven Brunette, the couple's Colorado Springs attorney who's taken up their cause.

The Rudnicks learned that the Legislature years earlier had basically removed a consumer's right to challenge a lender's standing to foreclose on a house.

The changes happened in 2002 and 2006 in paragraphs buried deep inside dense pieces"

And herein is the problem: Banks can appeal. ONE successful notary complaint in AZ has resulted in bank doing the unthinkable: moving court to remove the documents from country records. Can we smell rats???? In the following case the bank is basically saying that one of the tenets of law does not matter, if a person has no personal knowledge of debt they can still take away your home without proof and without judgement: Florida is non-judicial state in foreclosure procedures. Reminder if you bring action it then becomes of necessity a judicial foreclosure.

It reversed a 2010 Palm Beach County Circuit Court summary judgment that said the Glarum’s owed the bank $422,677.

“This decision could have broad sweeping application in the lending and loan servicing industries and effect thousands of foreclosure cases, among other types of cases, currently pending in Florida courts,” the alert posted on Greenberg Traurig’s website says.

WE've been telling you there was no real slowdown... .it was all a waiting game. Wonder what will happen since after foreclosure the government is only trickling the houses back onto the market in an effort to stabalize the economic impact. OH WAIT, it's okay to step up foreclosures to get through the pipeline quickly - but not okay to let the houses back onto the market to quickly reach bottom. There are properties still sitting after years of vacancies, what will happen in YOUR neighborhood. The biggest question I have is with all the foreclosures and bankruptcies, who is left credit worthy to buy or rent?

Mortgage default warnings surged in August - Yahoo! Finance: "LOS ANGELES (AP) -- Banks have stepped up their actions against homeowners who have fallen behind on their mortgage payments, setting the stage for a fresh wave of foreclosures.

The number of U.S. homes that received an initial default notice -- the first step in the foreclosure process -- jumped 33 percent in August from July, foreclosure listing firm RealtyTrac Inc. said Thursday.

The increase represents a nine-month high and the biggest monthly gain in four years. The spike signals banks are starting to take swifter action against homeowners, nearly a year after processing issues led to a sharp slowdown in foreclosures."

Call you Congressman: Homeowners about to be screwed again by investors


So everyone in the world knows that there was fraud in making mortgages and taking homes... Now the government and Banks own about 60- 65% of the housing market - maybe more. They are trickling homes onto the market but it is difficult to bu for many that have been victims of the FRAUD.. (robo signers is just a fraction of problem with foreclosures).

NOw they want to GIVE away the homes (basically) to the investors. Remember each state has received MILLIONS of dollars from the government with more on the conveyor belt ready to be doled out as the banks settle up with AG's/ Feds and INvestors. THE HOMEOWNERS got screwed and now are going to get screwed again.

Right now many homes ARE already being bundled up and sent to investors for $1,000,000.00.  Then they are rented out to people or sold for huge markups.  Check out HUD they have $1.00 program that is supposed to provided low cost housing to the poor.  Have you seen a house for a $1.00 yet?  Only non profits can buy them (or local government agencies).  It IS a nightmare for those wanting to buy.



A Huge Housing Bargain -- but Not for You - TheStreet: "On Wednesday, the Federal Housing Finance Agency (FHFA), the Department of Housing and Urban Development (HUD) and the U.S. Treasury Department issued a Request for Information (RFI) concerning the disposition of the inventory of foreclosed homes owned by the federal government.
An RFI is ostensibly a way for the federal government to get input from the private sector on how to accomplish the goals laid out in the request. But that's really just a facade, as the RFI was structured by the investors to begin with.
In reality, the RFI is a way for the members of Congress to find out if they can get away with bulk-selling these homes to private companies without incurring the wrath of their constituents, taxpayers and former owners of the properties.
Assuming taxpayers don't push back, the next step will be to issue a Request for Proposals (RFP). The RFP will be the bid and plan for these homes by investors."

Inmate Visits Now Carry Added Cost in Arizona - NYTimes.com: "“What will happen is that people will just stop visiting,” said the woman, adding that most prisoners “live for” visits from relatives. Because some friends of the family still do not know of her brother’s incarceration, she asked to be identified only by her first name, Shauna. She was one of several dozen family members of inmates who complained to Middle Ground Prison Reform, a group based in Tempe, about the fee.

In a lawsuit filed last month against the Corrections Department, Middle Ground said the fee was simply a pretext for raising money “for general public purposes” and as such was unconstitutional because it amounted to a special tax on a single group.

Middle Ground has also filed suit over another provision of the law, which imposes a 1 percent charge on deposits made to a prisoner’s spending account.

Donna Leone Hamm, executive director of Middle Ground, said she thought that state legislators created the background check fee “out of sheer financial desperation” at a time when the state faces huge budget shortfalls."

BofA, JPMorgan Among 17 Banks Sued by U.S. for $196 Billion - Bloomberg: "The Federal Housing Finance Agency, on behalf of Fannie Mae and Freddie Mac, filed 17 lawsuits yesterday in New York state and federal courts and in federal court in Connecticut . The FHFA accuses the banks of misleading Fannie Mae and Freddie Mac about the soundness of the mortgages underlying the securities.
“The loans had different and more risky characteristics than the descriptions contained in the marketing and sales materials provided to the enterprises for those securities,” the FHFA said in a statement .
FHFA is seeking to rescind the transactions plus other damages, including civil penalties and punitive damages in cases alleging misconduct."
