50 states investigation and Banks talking: Short Sales, $20,000 cash for keys?

Today my  Dad called excited to hear the news that the banks might be considering short sales as answer for homeowner with up to 20,000 cash for keys.  Dad spent some time reading the article to me over the phone, the excitement mounting in his voice as he explained that in his opinion the bnk might have to go back and redo the things they did wrong. I disagree but it would be nice if he is right.

If you have read the last link Florida AG 2 million settlement ..., then the next question will not surprise you at all.  I ask, " what the heck?"  Short Sales are already in place as option for the home owner. This is a serious negotiation, it is something to crow about; to tell the banks  to enforce what is already an option?   This investigation was launched after THOUSANDS of homeowners complained to attorney generals, providing documentation and pressure to address the fraud of the banks. After many  homeowner went to court trying to address fraud.  Is this negotiation helping homeowners who have lost their homes due to FRAUD perpetrated by the banks?

Now, the thought of up to $20,000 cash for keys is exciting for the homeowner, but does not even come close to the amount most homeowners lose in giving up their homes - without a "grumble". The fact that lawmakers still view foreclosures as caused by irresponsible homeowners and not to be rewarded with $20,000 cash, shows they have very 'little' understanding of what has been happening in this country for the past several years. They don't seem to see the banks as perpetrating FRAUD upon people and/or courts. The results of the investigation indicate there is fraud, or there would be no need to negotiate.

The new programs that are being considered as part of the negotiations might help some. In the past few years short sales were an option, but with tight time lines and a declining market many  real estate people said  that banks would not consider the offers they could get. It took a year or two for many real estate agents to learn how to negotiate short sales and get the banks to work with them more quickly.   BOA discouraged us from even trying saying that the price I thought we could get would not be approved and that there was not enough time. Remember this quite a while ago.

If banks are going to offer short sale then all offers must be considered in my opinion.  And plenty of time to allow the short sales, is crucial for success in short sales. Our neighbor's house sat on the market for over a year before losing it totally to foreclosure.  Another neighbor's home sold after sitting for several months as short sale and I suspect that our foreclosure helped along their short sale as there were now 2 homes sold for way less than original value.  The homes were revalued in the neighborhood for 2/3 the original value.   So essentially the new owners are paying payments at a fraction of the rest of the neighborhood is paying.  Those homeowners are barely hanging in as jobs change and the economy changes. In other areas of our city, homes are selling at prices that are under 1994 prices. "We've come a long way, baby!"

So back to the article,  if Dad is right and they offer ex-homeowners $20,000, does that make anyone happy?  The bank steals, defrauds and breaks rules, creates tax liabilities, degenerates cities  and the homeowner should allow it for 20,000 greenbacks.  Yep sounds like the "Merikan way", alright. Where do I sign up? (not)

Is the earth going crazy? NEW 6.5 earthquake and Tsnumami warning for Japan

Today it is Monday Morning in Japan and  a new morning brings a new 6.5 earthquake and a Tsunami warning is in effect. The Tsunami is expected to only be 1-2 feet high, but the flooding could impact rescue operations in a major way. HEY "MERICA - stop the war in Libya and go help out Japan!!!! 

This earthquake is in the same area as the previous 9.0 earthquake and resulting Tsunami which has crippled the nuclear reactors in Fukushima Prefecture.  Those reactors are still not in safety zone, leaking radiation, while rescue workers sacrifice their lives to repair the cooling as well as other damages.

Watching the reports of quakes one person has noted that it seems like a lot of quakes are happening in Japan, Figi and even in Nevada. 

CNN reported that the earthquake struck at 7:24 AM on Monday morning.

%The article in the intro below,  is a must read article.. I have been so puzzled by friends attitude, they seem to think a low dose of radiation doesn't matter... Paying more attention to microwave or cell phone dangers, than to the current crisis in Japan. I guess out of sight, out of mind? I hear, "I'm not worried." Well - Worry is one thing, sticking your head in the sand is another. Preparing for the "what if?" is not stupid. We can all see the conflicting reports on safety coming from officials. For years coffee is good, then bad, then good for you. Whatever your belief, try to be a little logical. Right now in America, there is nothing to "worry" about, but plenty to prepare for. Preparation by having a storm shelter is an American tradition in the midwest. Are they used all the time? Some years the storm shelter is not necessary - but when it is needed, it has saved lives. 

According to latest broadcast news there are high levels of radiation in the waters surrounding the reactors and even being reported in the sea.  525,000 gallons of fresh water is being made available by the USA miliatry to pump into the nuclear reactors. 5 tons of bottled of water are being distributed to Japanese.  I had already figured out that salt water should be temporary, it corrodes and now they are saying it leaves behind residue which clogs nuclear reactor lines. Meanwhile the radiation has leaked into the surrounding ground and sea waters, at 1250x the "safe" levels.  

IF you get too much radiation from even x-rays over your lifetime - it is a health risk. How many times have we heard that pregnant women need to be shielded from x-ray's while at dentist? Do you wear a seat belt?  Do you have an IRA?  Do you even lock your doors? 

I myself am not worried as much for me here and low level but I will take steps to increase my knowledge and protect myself and family.  I AM GOING TO BE BLUNT HERE: PREPARATION AND KNOWLEDGE LESSENS WORRY AND PANIC IN THE EVENT OF A NATIONAL DISASTER OF ANY KIND.

Florida AG 2 million settlement award: What about the homeowner?

March 26, 2011 - Yesterday, it was announced that the Florida Attorney General Office is receiving a settlement award of 2 million dollars.  The settlement is against attorney Marshall C. Watson and his law firm. A foreclosure mill which has been accused of improperly prosecuting foreclosure cases in Florida.

The distribution of the award is questionable and will not benefit those that have gone to bat to try to provide information to make the settlement possible.  Those who have lost their homes are already quite possibly on the street, in less than adequate shelter or staying with relatives. Homes have been ripped apart, pets left behind or split from family members. Jobs lost.  Wherever they are - those homeowners, rushed through foreclosure mill tactics,  were the ones injured. Florida State instead of helping with a settlement for those injured is using the settlement money to defray the taxpayer from funding investigation costs and to give a grant to Legal Aid to hire more lawyers to assist homeowners FACING foreclosure.   

With reservations which are outlined below we  applaud the determination to make law firms accountable for accuracy,

“We are aggressively investigating these law firms in order to protect the interests of everyone involved in foreclosure proceedings. Homeowners, lending institutions and the courts deserve to know that the law is being followed and all documentation is true and accurate,” stated Attorney General Pam Bondi. “Anything short of total assurance of complete accuracy during such serious situations is unacceptable.” - Florida AG 

If fraud is the basis of the settlement, shouldn't the fraud be reversed and the homeowner injured be compensated FULLY?  Where is the equity and where is help?   READ posts about the fraud perpetrated by the banks and then what is happening in courts.  Contract law is not being upheld except when it benefits the banks. Shouldn't part of the settlement have been fixing the wrongful foreclosures.  Shouldn't the state revise laws immediately to protect homeowners.  I want to be fair, spending money for Legal Aid lawyers to help prevent foreclosure actions is good but should not replace helping those already harmed by these seedy law firms. 

"Half of the $2 million payment from Marshall Watson’s firm to the Attorney General’s Office will be contributed to the Florida Bar Foundation to continue the Florida Attorney General Mortgage Foreclosure Grant Program. This grant program provides for the funding of Legal Aid attorney positions throughout Florida specifically devoted to the representation of low-income individuals facing foreclosure actions. " - Florida AG newsrelease

INQUIRING MINDS would like to know why it takes AG's to do the job (AND DETERMINE SETTLEMENT AWARDS) when the courts ARE NOT doing their job.  If Florida and other states had the judges with 1/2 the caliber of New York's Judge Schack, the necessity of the AG investigation would be moot point.  Taxpayer dollars would be saved and the economy could recover. 

Sometimes Government just looks at things backwards. For SEVERAL YEARS this wrongdoing has been ignored by courts, states and banks.  WE are talking MILLIONS of homeowners nationwide. Maybe we need to start suing the states to recover settlement damage for fraud perpetrated upon homeowners. Government seems powerless to help those that are really the victims in this whole toxic loan, mortgage fraud and foreclosure fraud mess. Anyone care to step up to the plate?

This morning the Syndney Morning Herold is reporting that Workers have been evacuated from the Fukushima Daiichi nuclear reactor due RADIATION BURNS being discovered on several of the workers. This is very alarming as the efforts being made are crucial to preventing a complete meltdown.  Yesterday experts were stating that it would be two weeks of fighting this, before it could be declared a non-crisis.  ON a side note tap water is fast approaching the official, unsafe level for adults as well as humans.

March 23, 2011  PM - Tonight, there is not much to update:  Black smoke still billows, and white smoke (steam) rises from the other reactors.   Drinking water in Tokyo is still unsafe and there is no end in sight.  It will be a day by day battle.   One expert believes that Black Smoke indicates an oil or electrical problem. So far, Libya, Yemen, the bombing of Israel and Elizabeth Taylor are ruling the news!  Gwen Stefani has donated 1 million dollars to relief efforts.
