Foreclosure Fraud = Failing Banks = Pension Fund Problems ?






I've been hearing a lot about Greece and the riots and stikes due to the huge debt load that the country can no longer afford.  It has spread to other European countries as well.  Argentina has gone through similar. In fact Switzerland is one of the few countries with low debt ratio.  I must admit I don't understand it all but I'm learning.

The greed of the banks in America very well could be our undoing. I caution the government officials,  when going after the banks, do not get big settlements for future foreclosure prevention or cleanup, but to return the money to those who have lost their homes wrongfully or are in process.  Send the criminals to jail and restore Americans rightful ownership.   Fraud visciates everything.. there was fraud so there is no contract, no loan , no foreclosure.

Viral Report of BANK FRAUD: BEST REPORT SEEN! Video included





BEST Report I have seen on the bank and political FRAUD involved in foreclosure fraud.  Now they need an in depth report on the MORTGAGE FRAUD.    If you are concerned that you might have mortgage fraud search through the blog posts using tool above.  OR Check Many of the blogs on the blog roll to right and join mortgage-challenge yahoo group and showmetheloan.net.   You can also find out about foreclosure fraud and resources on these groups.

30-90% are WRONG.  Everyone I know says the figure is 90% and sometimes more.

If you know someone facing eviction give them the information on where to get help by letting them know of these groups.   It is not to late.

Listen to the report above and pay attention to the securities and chain of title.   WE need to save AMERICA  and deal with the fraud.  FRAUD is FRAUD is FRAUD.  PENSION funds are affected.

"Citing the reporting of Mother Jones and the New York Times, Congressman Alan Grayson has sent a letter calling on the Chief Justice of the Florida Supreme Court to “abate” foreclosure cases involving three law firms currently under scrutiny from the Office of Attorney General Bill McCollum until the investigation is complete.

“If the reports I am hearing are true, the illegal foreclosures taking place represent the largest seizure of private property ever attempted by banks and government entities,” Grayson wrote. “This is lawlessness.”

The Attorney General’s investigation specifically names the Law Offices of Marshall C. Watson, Shapiro & Fishman, and the Law Offices of David J. Stern. Together, Grayson wrote, they account for nearly 80 percent of all foreclosure cases in Florida.

Ally's suspension may be due to several cases in Maine being pursued by a group of pro bono attorneys. While investigating complaints by homeowners about unjust foreclosures, the group discovered that the filings were all signed off by one GMAC employee, the "team leader for document execution."
In his deposition, this employee -- who signed documents for foreclosures across the country -- stated that when he signs them, he does not know what information the file contains other than the borrower's name, that he does not inspect the exhibits he's supposed to, and that the notary who supposedly witnessed his signing was not in the room. r

I am JAZZED -  TODAY I found wins in appellate court and blogged  about the CO-OP going against HUD.  Awesome! 


THEN  one of my auditor friends calls and tells me one of my favorite lawyers won a forcible detainer  against my nemesis Tiffany and Bosco.   GO LAWYER GO!!!! 
  


Not only that on another case yesterday this same lawyer stopped a trustee sale.  Big Deal you say- you've done that?   WELL get this!!!  He not only stopped the sale - it is STOPPED UNTIL the litigation is over.  These things have not been happening in YEARS.. .I stopped my friend long enough to ask him WHY didnt' I get invited to this party???????


 AND THAT'S NOT ALL - WAIT THERE'S MORE



Another lawyer in our group  (by the way)  Won the right to a jury trial.... 1st jury trial granted in foreclosure cases in 30 years.  Oh yes it IS Arizona State law that you have the right to a jury trial  - but our commisioners (acting as judges) DO NOT GRANT JURY TRIALS.  They MUST think it costs too much to allow a person their civil rights.  Makes you wonder doesn't it?

Goldman Sachs fined $27 million: largest fine in SEC history

"LONDON — Britain's financial regulator hit Goldman Sachs International with a 17.5 million pounds ($27 million) fine on Thursday for failing to notify U.K. authorities about an investigation in the United States.
It was the second-largest fine ever imposed by the Financial Services Authority, eclipsed only by the 33.32 million pounds fine announced in June against J.P. Morgan Securities Ltd. for mishandling clients' funds.

The British agency's investigation began in April after the U.S. Securities and Exchange Commission filed civil fraud charges against Goldman Sachs for allegedly misleading buyers of complex mortgage-related investments in 2007. Goldman settled the charges in mid-July by agreeing to pay $550 million — the largest penalty against a Wall Street firm in the SEC's history."

$1 billion nationwide: NPS foreclosure damage grant

Maryland foreclosures: State to get $6.8 million to help stabilize neighborhoods damaged by foreclosures - baltimoresun.com: "Maryland communities will receive $6.8 million to combat the damage that foreclosures have wreaked in neighborhoods, the federal government said Wednesday.


The grants are part of $970 million the U.S. Department of Housing and Urban Development is handing out nationally"   Additional locations receiving help include:


St. Louis REgion (including Illionois)  with award of  $16.2 million    this is in addition to the previous 14+ million awarded in previous years. Illinois will recieve $30 million


Oregon will receive funds. $5 million on top  two previous awards of  $19.6 million and $6.8 million. The state has used those awards to acquire more than 350 properties for rehab or resale in 45 communities including Portland, Gresham, Salem and Bend.




Nevada  who leads in foreclosures nationwide; expects $43 million to help with foreclosure
 crisis.. 




Florida  200 million.. .what is slap in the face -  where was  all the help for homeowners whose modifications were never considered and were not helped. Those who were evicted and yet now look at what is said: 


"These homes are going to be the primary residence of those who are working hard during these difficult times, yet are still struggling to own their own home," Brown said. "Additionally, the program puts people to work immediately since many of the homes require renovation."



NOTE:  What about the over 1 million people yearly nationwide that were trying to stay in their homes?

The sweeping bank reform bill, the Dodd-Frank Act, allocated the funds for the programs. "These grants will support local efforts to reverse the effects these foreclosed properties have on their surrounding neighborhoods," said HUD Secretary Shaun Donovan. States can use the funds to acquire land and property; demolish or rehabilitate abandoned properties. 


NOTE:  Read that bold part again... States  can now take advantage of homeowners who has their homes stolen (see florida) by illegal foreclosure mills etc.   Doesn't that just make your brown eyes - blue?  Let's see conflict of interest.... help homeowners?  or help grow cities or state lands?  Dont' staes make laws that affect the homeowners ability to win or lose their foreclosure fight in court?




NOTE:  the ultimate slap in face is evicting homeowners, especially those trying to get help, and then allowing THEIR tax dollars to help fund recovery for the aftermath of foreclosure frenzy




I could go on and on, but it is getting pretty disgusting to listen to ALL the taxpayer money being awarded, when this was PREVENTABLE.   Dont' get me wrong I think neighborhoods need cleaning up and crime preventation and restoration BUT I am sick at heart that states, cities, banks and insurance companies get funding and homeowners get the boot.

Not much to link to in news with short time on the weekend.. BUT WATCH for news about the FBI / Obama sweeps for bank fraud. Basically making fraud mortgages go back to originator if I heard the news correctly.

FANNIE MAE and FREDDIE are now OFF the stock exchange. 5 -10 years ago they were hot investment stock and now they are deader than a doornail for investing.

My Realtor friends say to watch for HUGE fall out with new avalanche of mortgages. One of my Realtor friends feels the banks are just holding back on some foreclosures. YOU tell us what you think................

How to find MORTGAGE and LOAN Fraud

Do you wonder if you have loan fraud?
Get out those closing documents!

1) Loan Rescission Notice - Many loans in 2006 did not receive copies of this important notice. If there is more than one person on the loan, each party is to have received a copy.

2) TILA law violations - TILA is the Truth In Lending Act check the link for laws and compare to your documents. You may want to pay for a forensic audit. If you need an audit email me alrady40@yahoo.com and I can refer you to reliable auditor. Did you know that if your loan closed less than 3 years ago you can rescind your loan fairly easily?????? A sister law to this is FDCA, Fair Debt Collections Act.

3) Amounts owing are in error or do not add up. A difference of just 65 bucks makes a HUGE difference and is a red flag to challenge the loan.

4) HOEPA I just recently learned about is that loans under 150,000 or interest rates of 8% or more, or points and fees in excess of $583 are red flags. This can be in violation of HOEPA,Home Ownership and Equity Protection Act. Many self employed people were given higher interest rates. We had a high rate but it did not qualify. FTC-HELP (1-877-382-4357); TTY: 1-866-653-4261.

DO You Need Help Reading Your Documents?

If you want a forensic audit you can have one done free through NACA.com. I have not used them and cannot vouch for how well they perform. I do have a forensic auditor I recommend to those that email me. The cost is reasonable and probably less than you pay for one months mortgage.

Finding fraud can help to fight foreclosure, save your home and give you the ammunition to modify that loan to benefit you and not the bank.

    Bank of America slapped again: Settled for 108,000,000

    This is great news for us that were hit hard by BAC. We were assessed excessive fees for drive by appraisels and they threatened property inspection by entrance to home on notice that property was vacant. Do they just MAKEUP facts? I wonder what they would have had to pay if they had not settled for 108,000,000. It sounds like a lot but is not much considering the accusations read around the net of fraud. Are the avoiding distration as it says? or something more sinister?

    Bank of America to Pay $108 Million in Countrywide Case

    WASHINGTON (AP) — Bank of America will pay $108 million to settle federal charges that Countrywide Financial Corporation, which it acquired nearly two years ago, collected outsized fees from about 200,000 borrowers facing foreclosure.
    The Federal Trade Commission announced the settlement Monday and said the money would be used to reimburse borrowers.
    Bank of America purchased Countrywide in July 2008. FTC officials emphasized the actions in the case took place before the acquisition.
    The bank said it agreed to the settlement “to avoid the expense and distraction associated with litigating the case,” which also resolves litigation by bankruptcy trustees. “The settlement allows us to put all of these matters behind us,” the company said.
    Countrywide hit the borrowers who were behind on their mortgages with fees of several thousand dollars at times, the agency said. The fees were for services like property inspections and landscaping.
    Countrywide created subsidiaries to hire vendors, which marked up the price for such services, the agency said. The company “earned substantial profits by funneling default-related services through subsidiaries that it created solely to generate revenue,” the agency said in a news release.
    The agency also alleged that Countrywide made false claims to borrowers in bankruptcy about the amount owed or the size of their loans and failed to tell those borrowers about fees or other charges.

    Because this one hits so close to our home it grabbed my attention. UTAH JUDGE has ordered that Bank of Amercia (BAC) must stop all foreclosures in UTAH. Because this is so important and INCREDIBLE - I am simply providing an introduction below this paragraph, to the blog that brought it to my attention. Shumate May 22, 2010 in St. George, Utah has stopped all foreclosure proceedings in the State of Utah by Bank of America Corporation, ; Recontrust Company, N.A; Home Loans Servicing, LP; Bank of America, FSB;www.envisionlawfirm.com. The Court Order if allowed to become permanent will force Bank of America and other mortgage companies with home loans in Utah to adhere to the Utah laws requiring lenders to register in the state and have offices where home owners can negotiate face-to-face with their lenders as the state lawmakers intended (Utah Code ‘ 57-1-21(1)(a)(i).). Telephone calls by KCSG News for comment to the law office of Bank of America counsel Sean D. Muntz and attorney Amir Shlesinger of Reed Smith, LLP, Los Angeles, CA and Richard Ensor, Esq. of Vantus Law Group, Salt Lake City, UT were not returned.

    3 things to do when talking to Mortgage Holder or BANK

    1) DO NOT go delinquent in order to try for modification. Get a forensic audit and negotiate with the bank BEFORE going late. THIS IS IMPORTANT the bank will tell you that you cannot modify because you are not deliquent. Once deliquent they will start modification process. PAY THE FULL amount paid previously, even if offered lower payments. Just trust me on that one.

    2) Do not believe them when they say they will call back or fax you. Call them weekly.

    3) Start a file with all details of conversations and all contact numbers. Keep computer copy and paper copy


    The thing is home modification offers are temporary and take time. The temporary trial modification lasts six months. You should not hire a modification company, spending thousands as there are many scams out there. Instead try to find good advice, perhaps consulting with a couple of different attournies. Bankruptcy if you are too far down the road in payments can be useful solution that a SKILLED lawyer can help negotiate saving your home for you.
