Seminar Review "Show Me the Loan"

Please retweet this blogpost if you find it helpful in learning about government mortgage homeownership and bank loan modifications

SHORT Review of the "Show Me The Loan" Seminar held this last weekend in Scottdale, AZ.

There was so much great information that it is almost impossible to know where to start. I have been involved with this group and meeting for a while now, so the information was not new.

What WAS great was having a workbook and DVD set up to help with the information in a more organized fashion. John has those tools available until supplies run out so contact the people on

http://showmetheloan.net

Darrell was AWESOME and gave information on how to talk to the bank PREVIOUS to any court hearings to reverse the foreclosure process. There are many laws and statutes that have to be followed to be able to complete the foreclosure procedure. I hope to write more on this later. Darrell is in process of writing a book. The biggest revelation for many in Darrell's talk was that you can inform the bank that their foreclosure procedures are not in compliance with law and very simply stop them in their tracks, and force them into starting over. He has done it several times. For some reason the banks haven't figured out how to comply with foreclosure statutes.

Cindy and her affadavit service was very enlightening and fits hand in glove with Bill McCaffrey's services for bank audits and expert witness. Her examinations of the notary signatures and dates will be valuable for many. If you have a report whose auditor will not be able to testify, then it may be worth your while to contact her and pay for her services.

John as usual was very informational and entertaining at the same time. For those not used to him - it can be a bit shocking but you will learn a lot listening to his experiences and his viewpoints about law and terminology.

Bill McCaffrey: I think the biggest thing from him was his normal information but also the statement that JOHN and CINDY are correct in their assessment of the notarization and dates shown on the DOT. Many of the DOT have stipulated that they must be signed and dated and the notaries are showing up as days and in some rare cases a month or so later. It is worth really examining your DOT (deed of trust) and the signatures.

More to come this week.

Eight credit-repair tips after bankruptcy Jennifer Waters's Consumer Confidential - MarketWatch

With HOUSING continuing to tank, unemployment staying high and home values plunging - more and more people will be filing for Bankruptcy. Here is some info that might drive out the fear and help you save your home. REmember strategic default will now mean that you cannot get credit to buy a home for 7 years.

Eight credit-repair tips after bankruptcy Jennifer Waters's Consumer Confidential - MarketWatch:
"A growing number of consumers are taking the bankruptcy plunge. U.S. consumer bankruptcy filings for the year ended June 30 popped 21% to 1.51 million. Coupled with the nearly 60,000 business bankruptcies in the same period, filings reached a level not seen since 2005.

Some 422,061 bankruptcies were filed from April to June, pushing past the 400,000 mark for the first time since the fourth quarter of 2005. At that time, 667,431 bankruptcies were reported as consumers rushed to file before Congress changed the laws that tightened eligibility.

There's some good news for filers: There's no red 'B' written on your chest.

'Nowadays lenders pay greater attention to other factors,' Watts said. 'If you mind your Ps and Qs after the bankruptcy, you can restore your credit rating once the bankruptcy data finally falls off your credit report.'"

Boca law firm calls foreclosure probe political

Editor note: WE have seen cases upon cases listed in blogs of how documents are actually FORGED. There are ways to tell if a document is original with original signature. Yellow dots and black lights are becoming staple in the fight against the banks.

Boca law firm calls foreclosure probe political: "The economic crimes division of the Florida attorney general's office is reviewing three firms following complaints that foreclosure documents were fabricated to rush cases through the court system.

Other firms included in the probe are the Law Offices of Marshall C. Watson in Fort Lauderdale and the Plantation-based firm of David J. Stern.

All three handle large volumes of foreclosure cases, which have increased substantially in recent years.

Attorney Gerald Richman is representing Shapiro & Fishman.

He called the attorney general's investigation a 'fishing expedition,' and questioned the timing of the Aug. 10 announcement, just two weeks before today's primary."

Changes in the Foreclosure Market: Are you ready

Please retweet this blogpost if you find it helpful in learning about foreclosures, evictions, government, mortgages, homeownership and bank loan modifications

PROFESSIONAL PREDICT FUTURE FORECLOSURES

Life just has a way of taking things and mixing them all up. Things are still crazy but the learning experience is incredible. Yesterday I talked to a forensic auditor that I had not met before. We talked a lot and shared experiences. Result is that I have a new opportunity to share information with people and learn more.

What is very apparent from each professional I speak with is that this is not coming to a halt anytime soon. I have reported previously of the millions that will be foreclosed on in next year or so. This professional said that there is an estimated 50 million foreclosures expected over the next (3) three years. Will you be next? I am looking for sources and reports on that. A few of my posts previous this one touch on the results and predictions of the foreclosure market. Do you think the financial genius Warren Buffett had it right when he talked with Obama? Leave a comment!

TRENDS

The NUMBER ONE THING that was reinforced from all I have learned both online and in local meetings, is that if you are going to fight your battles, you have to STAY ON TOP of things. Everything changes, from attitudes and methods, to strategies and effective documentation. What worked last year in legal battles may not work this year. In fact relying on "Show Me The Note" is not as useful a question as it used to be. Sending your bank a "Qualified Written Request" used to take a 1-3 months and now is taking 1 year or more if you receive it at all. I know this is not earth shattering news but it was reinforced over and over. Get support group, stay current and employ professionals whenever possible.

GET IT TOGETHER

We have seen locally as judges and lawyers change their strategies and responses to legal complaints. Banks have changed their strategies also - and as our local "gurus" say - get your stuff together NOW. Get all your documents together, record any crimes, get a forensic document examination, consider strategy and start saving your bucks to fight with help if needed. Learn your local laws. If you need templates there are free examples on our mortgage-challenge group or on Matt's Blog

With that in mind I will try to get more timelines and steps together for you. Meanwhile good-luck and if you are fighting for your home as we are, leave a comment... we would love to hear from you.

How to find MORTGAGE and LOAN Fraud

Please retweet this blogpost if you find it helpful in learning about government mortgage homeownership and bank loan modifications

Do you wonder if you have loan fraud?
Get out those closing documents!

1) Loan Rescission Notice - Many loans in 2006 did not receive copies of this important notice. If there is more than one person on the loan, each party is to have received a copy.

2) TILA law violations - TILA is the Truth In Lending Act check the link for laws and compare to your documents. You may want to pay for a forensic audit. If you need an audit email me alrady40@yahoo.com and I can refer you to reliable auditor. Did you know that if your loan closed less than 3 years ago you can rescind your loan fairly easily?????? A sister law to this is FDCA, Fair Debt Collections Act.

3) Amounts owing are in error or do not add up. A difference of just 65 bucks makes a HUGE difference and is a red flag to challenge the loan.

4) HOEPA I just recently learned about is that loans under 150,000 or interest rates of 8% or more, or points and fees in excess of $583 are red flags. This can be in violation of HOEPA,Home Ownership and Equity Protection Act. Many self employed people were given higher interest rates. We had a high rate but it did not qualify. FTC-HELP (1-877-382-4357); TTY: 1-866-653-4261.

DO You Need Help Reading Your Documents?

If you want a forensic audit you can have one done free through NACA.com. I have not used them and cannot vouch for how well they perform. I do have a forensic auditor I recommend to those that email me. The cost is reasonable and probably less than you pay for one months mortgage.

Finding fraud can help to fight foreclosure, save your home and give you the ammunition to modify that loan to benefit you and not the bank.

UPDATE on the homefront: Vacate the Judgement

Please retweet this blogpost if you find it helpful in learning about government mortgage homeownership and bank loan modifications

Current Status: We filed a motion to Vacate the Judgement within 3 business days. Since our mail service is screwed up we are checking the court dockets daily to make sure we do not have court date set without our knowledge. We did include an self addressed envelope (stamped - when did stamps hit 44 cents?) for the judges signed order. Some of you may not know that when you file a motion, you need to include a prewritten order for the judges ruling in your favor.

BACKGROUND: About 1.5 weeks ago we went to our forcible detainer trial (which we requested) and accepted more time to move out without giving up our rights to legal recourse. When you are in the courtroom things look different and nuances can be missed. By accepting that offer a judgement was handed to the bank's lawyers that they had the right to the enforce the fraudulent transfer of our home to themselves and call it a sale. I never heard the judge's gavel or anything remotely sounding like BANK WINS!

NOTE TO OTHERS: IF you are going to go to court make sure to go to similar hearings for several days and get used to what is going on. Watch and see the various shenanigans that happen. Practice what you will say and what the opposition could say. Take a legal pad and make notes. Or get a lawyer and most out there don't have a clue how to help you, so I would recommend using NACA's website for referrals.
