House Hunting, Fighting Foreclosure and Government Grants for the Homeless

Well the banks successfully evicted us after our year long battle.   Using last year's judgement instead of going through the forcible detainer (eviction) again.  Bankruptcy for some will still be a good option for fighting through the legal system. Make sure if you go through bankruptcy that you learn as much as you can FIRST, or have a very trustworthy person guiding you.

For other people doing a  notary complaint process and documenting the fraud for a lawsuit will be a better answer.

Going through this process has taught us a lot.   Find your alternative housing long before you end up evicted.  It is not dishonest to plan ahead, the banks are a business and all is considered as contract law. It is not dishonest to plan to take care of your family while fighting the fraud and  negotiating with the banks to honor THEIR contracts. For instance have they fulfilled the obligation for the qualified written request within 90 days? Have they committed TILA violations, have they broken Fair Debt Collection Act? Were you robo signed?  There are many FRAUD issues.  Make sure to check out showmetheloan.net or the blogs listed in my blog roll to the right to educate yourself on more issues.  You can also check past blogposts on this blog using search for key terms.

REAL ESTATE: LARGEST GOVERNMENT LAND GRAB

Right now we are seeing a new thing on listings for homes for sale by banks.  In our search for cheap housing we found that HUD is awesome source of free housing - FOR INVESTORS.  The government in it's land grab has taken over most loans from banks via Fannie and FHA etc.  They account for about 63% of real estate listings.  This means that the government is the direct benefactor of  "non performing assets".  Remember these mortgages were sold to investors already (money made) then again were paid for with insurance funding for investors and insurance when house was foreclosed on.   Now the government owns them free and clear and unlike a straightforward real estate advertise, buy and close - they are holding out for highest bidder.   We found this out when looking for a 37,000 piece of property with trailer that was advertised as available.

So essentially the government is grabbing homes with a call to increase the foreclosure process, then they are holding up people from investing outright in a new home by bid competition-AND on the other hand they are spending money to fight the homelessness they are inflicting on people.  Remember in foreclosure you have 5 days to get out, once the bank notifies you. Technically once the auction or trustee sale has happened - you are homeless, until you can have it overturned.   The government is in control of about 63% of those foreclosures, they could stop the train there, instead they are granting millions of dollars to homeless programs, including a new 16.4 million to combat rural homelessness.   Hard to say this but we are now one of the homeless, partially due to the lack of action by government in dealing with the fraud.  AS with any other government process, funding will be hard to access by those who need it.

But I digress, back to the house hunt. We went and talked with neighbors of the advertised home,  who told us that the home had sold one month ago for several thousand over the asking HUD price. The happy new owners and paid out cash total of something like 63,000, obtained keys and were waiting for the green light to move in or rent it out. We quickly learned that HUD advertises one price, then holds out and extends the listings, waiting for highest and best cash offer.  INVESTORS are snapping up the medium priced properties. Thank you government for not stopping robo signing, fraud and correcting wrong - but for taking advantage and lining the  coffers of the governmental 'spendaholics'.  Does this type of thing sound familiar? Fix and Flip prior to the housing crash?

BANKS DEFENSIVE ADVERTISING

On Trulia the real estate owned by banks (REO) is being advertised in a very defensive and inaccurate statements.   HERE is a sample wording from one listing:
Bank Repossessed. This property has completed the foreclosure process and is now owned by the foreclosing lender, which took title to the property for an estimated consideration (loan balance plus other fees and costs). Foreclosing lenders are often motivated to sell bank-owned properties (also known as REO, or Real Estate Owned) quickly because they are non-performing assets. Please register for a free trial with RealtyTrac to access complete information for this property, including full address, foreclosure details, lender information, and more.
If you have been following this blog and others you will know that the foreclosure process is not complete - there is the return of the security instruments according to UCC 3 -501 B.  There are many lawsuits and possible clouded title.  Chain of title could still be compromised.  They have taken title alright - stolen in many cases from owners who have not questioned if all payments were applied to the mortgage or if they were target of toxic loan or robo-signer.   The fact that they are advertising this is troublesome to many in the t foreclosure fight arena.

WE ARE WORKING ON IT!

Now we are back to square one working on our legal processes, while looking for a place to house us for the next six months to one year.   We are also rebuilding our business.   WE are in temporary situation and life is good.  If you hear of a great property with cheap housing for under 50K let us know.. or a home to care-take while the homeowners are fighting their foreclosure. :)  Let us know how your foreclosure fight is going by leaving a comment.

BAC or Bank of America: Foreclosure Freeze is Nationwide 50 states

Statement from Bank of America Home Loans

Bank of America has extended our review of foreclosure documents to all fifty states. We will stop foreclosure sales until our assessment has been satisfactorily completed. Our ongoing assessment shows the basis for our past foreclosure decisions is accurate. We continue to serve the interests of our customers, investors and communities. Providing solutions for distressed homeowners remains our primary focus.”

FURTHER INFORMATION  for customers:

1 800 809 0231 BOA customer

1-800 669 6607  Country Wide customer

**************************************************************

MY EXPERIENCE:    I called the press line to ask question for my blog.  Left a message and await a call to answer my questions.

I called the hotline above - as a Country Wide customer.  The recording states that  they are BOA, a company that services  your home  loan.  Since I have been foreclosed and evicted last spring, I was surprised to learn that I show as active customer.  They are debt collector. And are recording my call for  quality assurance. Big surprise there, right?

I was cut off... so 2nd try.  Similar to above only there is no way around giving up your information. You must have account number or social and zip code. This time I pressed the button reflecting that  I wasn't interested in home retention division; but,   I was sent there and advised that they are debt collector.

After a few moments with representative I was transferred to the REO department. From there, I was placed on hold.   If you want to become an REO real estate person press 2.  Not me, I pressed 3 for escalation of REO.  We will see.  Another wait.... OOPS voice recording... your call was unable to be completed, please hang up and call the toll free number again.  I guess none of the choices applied to me. I think choice one was for finding REO properties, again I wouldn't' buy a foreclosed home unless deeply desperate.

No thanks,  this is part of what my problem of dealing with Banks has been.  transfer, wait, transfer wait and a huge cell phone bill later!   Good Luck with your calls. If you are not evicted yet, then you will have a much better experience than me. :)

Senator Franken wants GMAC investigation!

Share |

Well other politicians are getting into the pressure cooker toward the banks that are defrauding people of their homes.  We are working to get our state's politicians to do anything other than spend money on the problem.  We live in the 2nd largest state for foreclosures and there is no public addressing of the robo-signatures, fraud mortgages, fraud documentation or falsely recorded documents.  Banks lie in court on a daily basis and the numbers are staggering.   Go watch court and see for yourself.

Do you know how many courthouses in Phoenix alone deal with this?  How many cases daily?  That is just one major city.   Multiply that by all  cities  in all 50 states. .

See the below letter by  SENATOR FRANKIN.  If more of our political leaders would get involved then we might see some progress.  Sadly,  I do not think it will do anything for those in process other than halt things for a few months.   It seems the leaders are wanting investigations but do  they have the kahunas to return properties to those cheated?

Today WALSH announced that there will be investigations into 7 banks. I am confused as to why GMAC or Ally is not on that list of 7 institutions being investigated.

Or will they just say fix the paperwork and ignore the UNDERLYING fraud on mortgages not to mention the  violations of Tila/respa laws?   If this is addressed in a meaningful way it might mean the writing off of milllions of fraudulent toxic cases.

Thanks to the blogs on the right for keeping up with information, Thanks to google for always having links and thanks to new to me http://www.zerohedge.com for bringing to light the letter from Franken.

I have a dream - that someday all foreclosure will be reversed

Okay, the title got you right?   Well that dream is true and I am working hard with others to make it a reality! There so many people from the "Show me the Loan" group,  the auditors, lawyers, bankruptcy help group and other groups -   fighting  the rampant fraud across America. .  Hopefully by having up to date news, support groups, information share and referrals to expert help that "gets it" - we will be one step closer to reversal of all mortgage fraud and wrongful foreclosures.

I have a twitwall and it is very useful for some things.  IN it I can promote articles that you all like and that are helpful to others.  I can track responses and group topics.

This week I noticed that the articles I thought would be the most popular such as "Donald Trump and The Apprentice Talk Recession" or "Real Housewives Talk Foreclosure" - well those were not the most popular topics.  I put together a report gathered from stats on the blog and on shortening links as well as responses from twitter.  To me it was very surprising.   People are hungry for news. Especially if that news is affecting their personal live right now.

Here are the 5 most visited blogposts by page view -  visited this last week!  They were not necessarily the ones that earned the most money, but apparently they were the most useful to people.

Local news endorses self defense: Foreclosure Seminar soon

Your legal rights in foreclosure: "When home foreclosures are taken to court, many homeowners can't afford a lawyer and end up going toe-to-toe with a bank's attorney in front of a judge. Despite the disadvantage, some people do succeed in keeping their home or at least delaying eviction.

Homeowners commonly end up in court after their mortgage goes into default, the lender has auctioned the home and is ready to evict the occupants. The bank asks a judge to rule on a 'forcible detainer' which affirms the bank's right to take possession of the property.

Valley attorney Doug Rhoads says it is possible for individual homeowners to represent themselves in court, which is called 'pro se' in law terminology. 'In the initial appearance you can handle this. You might actually be able to win.'

and this excerpt:
Usually offered once a month, the seminar is hosted by a Valley loan auditing firm, National Litigation Support Services LLC.

Temporary Restraining Order Granted in Arizona: Foreclosure mill grinds on

Please retweet this blogpost if you find it helpful in learning about government mortgage homeownership and bank loan modifications

Yesterday there was great stride forward in foreclosure fight. One of our group of foreclosure fighters won a Temporary Restraining Order right away. There are programs out there, yes, that CLAIM to save all homes. They are nationwide and the program is very expensive and NOONE can guarantee 100%... the claims are a little exaggerated. Arizona is a whole different story from the START.

Banks are not just favored, their outright lies are ignored in court. There are very very few evictions that are stalled, or postponed let alone denied. Evictions are based on ONE piece of paper that is usually not even an original.

Temporary restraining order to keep the bank from foreclosing until a lawsuit is heard is RARE. It happens but the games they play to get owners to just give up is incredible. That is one reason I recommend the JurisDictionary Course (see right column) for homeowners with little to no court experience. They need information fast. I do receive a small referral fee but have recommended this course before signing up for affiliation.

YESTERDAY a marvelous work of art happened. One of our group of foreclosure fighters won a Temporary Restraining Order right away. No waiting for decision. In the past several have had their TRO heard but the judge have had to wait for over a month for the judgement, usually a denial. To me this is signalling the end of the banks being taken at their word in Arizona. The documents used to reach this legal decision are available on the show me the loan website. There is also an upcoming seminar on labor day.

Owner of Home Sold at Auction Sues Bank

Editor note: WAtch the video and editors note at end of article !

Owner of Home Sold at Auction Sues Bank:
"The 2,600-square-foot Spanish-style house was once valued at a million dollars. But Williams fell behind on his mortgage, and turned to Bank of America for a loan modification.

'I was told I was doing everything the right way,' he says. 'I wanted to stay in the house, I wanted to keep the house --
I did everything Bank of America told me to do -- and one morning I get a call and the house is no longer there.'

Williams says the bank started working with him in September of last year, and then sold the home without telling him.

'They sold the property out from under me for $192,000 -- a million dollar property.'

Williams was given one month to move out of the home he and his family had spent 10 years working on.
But Williams isn't going quietly.

He is suing Bank of America for $100 million to send a message. Wednesday in federal court, the judge ruled the case could go to trial."

KUDOS TO WILLIAMS!!!!!!!!!!!!!!

Editor note: This man was LUCKY to have this happen. BOA seldom says they help people but they do not allow everyone to actually APPLY for modification.. They weed you out by phone. If he had continued with the modifications (which are basically just lowering payments) his loan would have been modified at his current principle - now they will have to deal with the actual property value.

What happened to this man is not unusual - it is the NORMAL course of action by the servicers. Many are not even legally able to foreclose but do it anyway. This is happening to the majority of people in default. It happened to us. BOA sold at trustee sale WHILE in possession of our letter of rescission and accusation of fraud.

The foreclosure holocaust is not over. I think it will be worse in the next year than ever before. STrategic walkaways are going to find they can't obtain mortgage loans for 7 years..... What is happening in America debt wise is criminal. If Americans don't wake up and start revolting like some of our counterparts in other countries, we will end up sealing the fate of our nation.

Class Action RICO Suit Alleges Tens of Thousands of New York Foreclosure Frauds Orchestrated by "Foreclosure Mill" Attorney & Banks

There is more coming down the pike with decisions yesterday but the news is being VERY VERY slow to pump out negative press on this stuff. THIS ARTICLE is worth a FULL read so make sure to check out my blog and then click on the article title to read the full article.

Class Action RICO Suit Alleges Tens of Thousands of New York Foreclosure Frauds Orchestrated by "Foreclosure Mill" Attorney & Banks: "Case #10CV3800. It alleges RICO civil racketeering, RESPA, Fair Debt Collection Practices Act violations and that homeowners paid inflated foreclosure and other fees fictionalized by Mr. Baum who profited from the scheme since 2005.
The action seeks to return tens of thousands of foreclosed homes to their owners or the values thereof and hundreds of millions in punitive damages against Mr. Baum, MERSCORP and HSBC."

Boca law firm calls foreclosure probe political

Editor note: WE have seen cases upon cases listed in blogs of how documents are actually FORGED. There are ways to tell if a document is original with original signature. Yellow dots and black lights are becoming staple in the fight against the banks.

Boca law firm calls foreclosure probe political: "The economic crimes division of the Florida attorney general's office is reviewing three firms following complaints that foreclosure documents were fabricated to rush cases through the court system.

Other firms included in the probe are the Law Offices of Marshall C. Watson in Fort Lauderdale and the Plantation-based firm of David J. Stern.

All three handle large volumes of foreclosure cases, which have increased substantially in recent years.

Attorney Gerald Richman is representing Shapiro & Fishman.

He called the attorney general's investigation a 'fishing expedition,' and questioned the timing of the Aug. 10 announcement, just two weeks before today's primary."

Changes in the Foreclosure Market: Are you ready

Please retweet this blogpost if you find it helpful in learning about foreclosures, evictions, government, mortgages, homeownership and bank loan modifications

PROFESSIONAL PREDICT FUTURE FORECLOSURES

Life just has a way of taking things and mixing them all up. Things are still crazy but the learning experience is incredible. Yesterday I talked to a forensic auditor that I had not met before. We talked a lot and shared experiences. Result is that I have a new opportunity to share information with people and learn more.

What is very apparent from each professional I speak with is that this is not coming to a halt anytime soon. I have reported previously of the millions that will be foreclosed on in next year or so. This professional said that there is an estimated 50 million foreclosures expected over the next (3) three years. Will you be next? I am looking for sources and reports on that. A few of my posts previous this one touch on the results and predictions of the foreclosure market. Do you think the financial genius Warren Buffett had it right when he talked with Obama? Leave a comment!

TRENDS

The NUMBER ONE THING that was reinforced from all I have learned both online and in local meetings, is that if you are going to fight your battles, you have to STAY ON TOP of things. Everything changes, from attitudes and methods, to strategies and effective documentation. What worked last year in legal battles may not work this year. In fact relying on "Show Me The Note" is not as useful a question as it used to be. Sending your bank a "Qualified Written Request" used to take a 1-3 months and now is taking 1 year or more if you receive it at all. I know this is not earth shattering news but it was reinforced over and over. Get support group, stay current and employ professionals whenever possible.

GET IT TOGETHER

We have seen locally as judges and lawyers change their strategies and responses to legal complaints. Banks have changed their strategies also - and as our local "gurus" say - get your stuff together NOW. Get all your documents together, record any crimes, get a forensic document examination, consider strategy and start saving your bucks to fight with help if needed. Learn your local laws. If you need templates there are free examples on our mortgage-challenge group or on Matt's Blog

With that in mind I will try to get more timelines and steps together for you. Meanwhile good-luck and if you are fighting for your home as we are, leave a comment... we would love to hear from you.
