WRONGFUL Foreclosure spur Bank Break-In: Not Foreclosed !

The Foreclosure Mills keep churning, Senators and Attorney Generals demand answer, and Banks freeze foreclosures to cover their perjurious documents submitted to courts.

We thought just evicted people by lying to the courts was horrific but these two news reports confirms that the rush to foreclose is not only illegal but potentially dangerous.   Dangerous for the contractors and for the homeowner and possibly for bank executives who might need to start watching their backs while eating out.


I have not hear much said about it - but what were the contractor's thinking?  I can be quiet while I am home but usually there is some sign that the house is NOT vacant.  Mussed up gravel in the driveway,  possibly a dog barking, TV set or a clean front porch are usually clues that the house has occupants.



LEAVE  THE LIGHT ON  = SHOW YOUR SUPPORT

This is outrageous that the woman was not in foreclosure proceedings.  Does it matter if she was in foreclosure or the foreclosure had been completed with sale?

WHAT right does ANYONE have to change the locks with people residing in the house?  I thought that was what the scary summons to court for forcible detainer (*eviction proceedings) was about: Eviction first, change locks later.  You can my upclose and personal post to read  about forcible detainer action.   Generally,  a Sheriff's deputy comes knocking on your door, which can be scary enough.

I am now going to print this post  and tape it to my front door - with that action I will ask you to join me and  LEAVE  THE LIGHT ON  = SHOW YOUR SUPPORT.  It may raise the electric bill, but I'm sure it's for a worthy cause. Stop the madness: call or email  3 government officials  this week  asking them to stop foreclosures across America.

Wells Fargo Settlement with Arizona: Terry Goddard AG

Well it is a small start. Thank you AG. NOW can you make it more than just forcing a refi? What about hundreds of people already WRONGFULLY evicted from their home in past couple of years??? I do appreciate the good hard work done and some of my friends faceing foreclosure NOW will benefit.  I would like to see the CROOKS in JAIL though. And let me see if I understand this right..... the AG office is given 2 million by Wells FARGO to prevent foreclosure... meanwhile I have friends evicted and financially ruined,  who could not get relief earlier.

My friends won't get relief now, because you have to refinance to get the relief.  you can't refinance if you are out of the home.

Let's see:   So while you get 2 million for fighting foreclosure; my friends get the boot, and  upturned life  with the bonus of  a 7 year blight on credit.  All this and more  for fighting foreclosure and morgtage fraud.  Yup sounds equitable to me.  (sarcasm intended).

Don't get me wrong I am thrilled you got settlement. At least it's something; however,  I would still  like to see the CROOKS in JAIL . 

Arizona Attorney General Terry Goddard: "(Phoenix, Ariz. - Oct. 6, 2010) Attorney General Terry Goddard today announced a multi-state agreement with Wells Fargo Bank ('Wells Fargo') over allegedly deceptive marketing of payment option adjustable rate mortgage loans ('POAs') by two companies it acquired: Wachovia Corporation ('Wachovia') and Golden West Corporation ('Golden West').

At least 1,718 Arizona POA borrowers will be eligible for loan modifications that will provide almost $154 million in mortgage relief in Arizona, Goddard said. This sum includes more than $86 million in principal forgiveness for Arizona homeowners. The eligibility period for modifications to be made extends from April 1, 2010, to June 30, 2013. Wells Fargo will also pay $2.1 million to the Arizona Attorney General’s Office to assist the State’s efforts to prevent or mitigate foreclosures and prevent mortgage or loan modification fraud."

Foreclosures Are Making People Sick - New America Media: "The foreclosure crisis is affecting tenants and homeowners, according to the public health agency. When banks repossess a home, they seldom bother to maintain it before putting it on the auction block, and the consequences can affect residents’ health, according to a study by Just Cause last summer that was funded by The California Endowment.

The study looked at how the high rate of foreclosures in select East and West Oakland neighborhoods had affected the health of their residents. A survey of 388 residents concluded that “foreclosures make us sick.”

Between 2006 and 2009, one in four mortgages in Oakland, affecting 14,941 property owners, began to enter into foreclosure, according to the report, titled, Rebuilding Neighborhoods, Restoring Health.”

Alameda County Health Department Deputy Director Dr. Sandra Witt highlighted the report’s findings.

Among them were:

� Almost one-third of tenants in foreclosed properties said they were living in sub-standard conditions with health risks due to mold, pests and utility shut-offs.
� Rates of stress, depression and anxiety were more than two times higher among foreclosed residents.
� Nearly 90 percent of foreclosed residents were struggling to make ends meet. Many have to choose w>>>KEEP READING"


UPDATE NOTE:  Just heard on the news that drinking increases as stress mounts during foreclosures...afterwards unable to afford the booze, people go through withdrawals. DT's prompt emergency room visits.  Alcohol withdrawal is the only drug withdrawal that can cause death according to the televised report.

I do agree do not be afraid, tell your story and I would add GET YOUR DOCUMENTATION (nlss.audits@gmail.com) and learn all you can. Are you fighting foreclosure or eviction????
You don't even have to be deliquent to learn and prepare.

Although they are focusing on the forcible eviction, Atttorney Doug Rhoades explains that you can represent yourself in eviction. This is great article. If you are deliquent start studying now and try to prevent the sale. See my link to yahoo's mortgage- challenge group.
