Deeds of Trust -Invalid without Seal?

Today, we were amazed as we learned about the newest theories in Mortgage Fraud. Today's theory is explained further down this post and the idea is that  that ALL Deeds of Trust (DOT's)  in the USA are invalid due to the absence of the maker/signor's seal.

Some of John Stuart's  recent theories have been substantiated by some attorneys and experts in banking; theories include:  did  you ever receive a loan,  is your promissory note  monetized; is the note invalid by being turned into a check with the stamp: "without recourse",  does your Deed of Trust contain proper signature date or notary fraud.  What we do know for sure is that  YOUR promissory note was securitized and sold for millions of dollars that you did not receive; which is part of the reason you cannot get your note back, because of this fraud. The Deed of Trust when separated from the Promissory Note is dead in the water and invalid.

We have seen,  in one court case, four "original" notes being presented to the judge as evidence of a loan.  Since the Deed of Trust would not be referring to FOUR "originals" it is invalid.  Will the Court state that? It remains to be seen. They did confiscate the note and turned it in for investigation. Will this be available for public record - I don't know, but you should keep a close eye on all the cases you can.

The fraud is rampant and it is up to you to prove it.  Many of the blogs to the right will explain various types of problems with notes and loans.Recently John Stuart pointed out notary fraud as well as document fraud in the filing of foreclosure documents.  Two weeks ago he pointed out how in Arizona,  for instance,  deeds of trust often have wording that indicates the document is to be signed and dated on the same day; and yet, notary seals are applied several days later.

Today, John Stuart was sharing his theory that all deeds of trust currently are invalid because they do not have your signature seal.  To understand why, you may need to Google search the word SEALS and see how, until recently, they were a part of your signature. Signed, Sealed and Delivered.  Right now, for the last 70 years we have only Signed and Delivered, but have not Sealed our signatures.

Does anyone think this will change anything?  Probably not, as lack of seals on signatures has been UNCONTESTED for over 70 years.  My experts agree with this  theory, but say its just not going to fly.  If you can figure out how to make this work for you, more power to you.  With the new age of digital seals, people may be back into understanding and designing their own signature seals.    Finding information is difficult but you can learn about it with a little effort. Wilkepedia does not go into depth but does touch on it.  I may order a signet ring similar to what is in the picture,  just in case!

I will be checking this all out, because wild or not John has been right on the money for his other theories. Until then,  I  thought you'd like this history lesson.

SHORT Review of the "Show Me The Loan" Seminar held this last weekend in Scottdale, AZ.

There was so much great information that it is almost impossible to know where to start. I have been involved with this group and meeting for a while now, so the information was not new.

What WAS great was having a workbook and DVD set up to help with the information in a more organized fashion. John has those tools available until supplies run out so contact the people on

Darrell was AWESOME and gave information on how to talk to the bank PREVIOUS to any court hearings to reverse the foreclosure process. There are many laws and statutes that have to be followed to be able to complete the foreclosure procedure. I hope to write more on this later. Darrell is in process of writing a book. The biggest revelation for many in Darrell's talk was that you can inform the bank that their foreclosure procedures are not in compliance with law and very simply stop them in their tracks, and force them into starting over. He has done it several times. For some reason the banks haven't figured out how to comply with foreclosure statutes.

Cindy and her affadavit service was very enlightening and fits hand in glove with Bill McCaffrey's services for bank audits and expert witness. Her examinations of the notary signatures and dates will be valuable for many. If you have a report whose auditor will not be able to testify, then it may be worth your while to contact her and pay for her services.

John as usual was very informational and entertaining at the same time. For those not used to him - it can be a bit shocking but you will learn a lot listening to his experiences and his viewpoints about law and terminology.

Bill McCaffrey: I think the biggest thing from him was his normal information but also the statement that JOHN and CINDY are correct in their assessment of the notarization and dates shown on the DOT. Many of the DOT have stipulated that they must be signed and dated and the notaries are showing up as days and in some rare cases a month or so later. It is worth really examining your DOT (deed of trust) and the signatures.

Temporary Restraining Order Granted in Arizona: Foreclosure mill grinds on

Yesterday there was great stride forward in foreclosure fight. One of our group of foreclosure fighters won a Temporary Restraining Order right away. There are programs out there, yes, that CLAIM to save all homes. They are nationwide and the program is very expensive and NOONE can guarantee 100%... the claims are a little exaggerated. Arizona is a whole different story from the START.

Banks are not just favored, their outright lies are ignored in court. There are very very few evictions that are stalled, or postponed let alone denied. Evictions are based on ONE piece of paper that is usually not even an original.

Temporary restraining order to keep the bank from foreclosing until a lawsuit is heard is RARE. It happens but the games they play to get owners to just give up is incredible. That is one reason I recommend the JurisDictionary Course (see right column) for homeowners with little to no court experience. They need information fast. I do receive a small referral fee but have recommended this course before signing up for affiliation.

YESTERDAY a marvelous work of art happened. One of our group of foreclosure fighters won a Temporary Restraining Order right away. No waiting for decision. In the past several have had their TRO heard but the judge have had to wait for over a month for the judgement, usually a denial. To me this is signalling the end of the banks being taken at their word in Arizona. The documents used to reach this legal decision are available on the show me the loan website. Mike Rothermel is hosting a SEMINAR on Saturday July 10th and 11th, 2010. John Stuart will be the main speaker. On Sunday, July 11th John will conduct a "Moot Court" that is a local weekly event.

John Stuart is to be the main speaker at the seminar and he has agreed to speak most of the day on Saturday about his "SHOW ME THE LOAN" doctrine, William McCaffrey will close out the day and they will hold the regular Sunday Phoenix Moot Court, with additional information, at this splendid venue.

The information John will speak of are His discoveries and theories, you will not get His information anywhere else except the mock court classes in Phoenix. You will learn about the banking and document fraud that proves conclusively you NEVER received a "LOAN" and the Banksters did "BUY" your Promissory Note. "Show Me the LOAN" is what We should be screaming. John will be going over why the "Show Me the Note" defense/offense should not work and is a moot point. He will explain how to go after the Banksters for the "Show Me the LOAN" concept, among other issues and topics relating to the fraudulent, felonious and criminal Foreclosure activities of the Banksters and their Attorneys.

William McCaffrey will take the floor for the last hour and a half of the Saturday session. He is an expert in the Banking industry and He testifies as an expert witness on behalf of homeowners regarding fraud committed by the banks. He will explain the mortgage pooling and servicing agreements, who really owns the note, and how loans are pooled into mortgage backed securities which are traded on the stock market!

The tentative schedule for the Saturday class will be 9am to Noon, lunch until 1:30 pm, and class until 6 pm with a couple of smoke and facilities breaks in both sessions. Sunday will be Moot Court, from 9:30am to 2 pm or longer if need be. John will grill the expert witness from the banks perspective and from the homeowners.
