Foreclosure Defense Heats Up: One Notary Complaint down 10,999 million to go

Court battles are happening all over the country, as you read various blogs, you see various levels of success and failure.  Until recently, Arizona had few successes. We have had a few TRO's granted.  NOt much progress, but a lot considering the level of corruption in Phoenix.  We may exceed Los Angeles in corruptness. Recently however we have had in the foreclosure fight a few good progressive wins. In the area of notary complaint we have had a couple of notary robo-signers revoked license and/or disciplined.   One is a banner for the showmetheloan.net site.
       Please be advised that Kristin B. Lindner's notary commission has been revoked -source showmetheloan.net
That advisory is proudly displayed on the site, and rightfully so.  Anyone using that notary can now address (with more ease) the robo-signing by whichever bank is represented. If you have that notary, then you know which bank uses her signature.

It seems to be that going after the appropriate agencies that regulate lawyers, and judges should be next. I never thought that the saying "Justice is Blind" meant that courts would turn a blind eye to the mortgage, servicing and foreclosure fraud that has infected our country.

Juan Williams: NPR - Fox and Free Speech v. Foreclosure -Gate

Well -  this might be a stretch from foreclosures,  but there are some similarities between what is happening to Juan Williams being fired  by NPR for his words spoken on Fox; and what I see happening in the foreclosure world.  AT least that is how my increasingly cynical mind see it.  I am seeing government control creeping in places where we least expect.

JUAN, as you may know,  made some remarks on a Fox show  - that National Public Radio assessed, disliked and fired him  - for words uttered.  Not much of a problem if its a corporation like  CNN -  however,  these are PUBLIC-ALLY FUNDED administrators in charge of the censorship of Juan; who was speaking  outside of his normal radio show.   Does that make sense?  He was speaking what many Americans are feeling and voicing.  Not words of hatred, but of observation. 

The Public-ally   FUNDED radio show  (via your tax dollars),  has fired Juan Williams for speaking words that are not government approved.   Now this might not seem like a big deal, but it is not the job of government to decide what free speech consists of.   Hate speech perhaps, but reflecting the views of the public at large is part of the job of Nationally Public Radio.    I may not know enough about this issue,  but it seems like a  "bit" of overreaching on the part of NPR.   

THE LIKENESS to foreclosures is that  Courts are deciding what the PUBLIC can SAY or not SAY in defense of themselves in eviction,  due to foreclosure.   Forcible Detainer  is the name;  and Silence the Defense is the game.   CENSORSHIP by firing the Defendant; also known as the  homeowner.    It is shameful what is happening to homeowners across this nation

Hopefully, NPR will come to its senses and retain Juan Williams.  If not, maybe Juan woudl like to write for my blog.  Not much money in it, but JUAN WILLIAMS could help save America, ONE HOUSE AT A TIME.

MY EXPERIENCE:    I called the press line to ask question for my blog.  Left a message and await a call to answer my questions. 


I called the hotline above - as a Country Wide customer.  The recording states that  they are BOA, a company that services  your home  loan.  Since I have been foreclosed and evicted last spring, I was surprised to learn that I show as active customer.  They are debt collector. And are recording my call for  quality assurance. Big surprise there, right? 

I was cut off... so 2nd try.  Similar to above only there is no way around giving up your information. You must have account number or social and zip code. This time I pressed the button reflecting that  I wasn't interested in home retention division; but,   I was sent there and advised that they are debt collector.   

After a few moments with representative I was transferred to the REO department. From there, I was placed on hold.   If you want to become an REO real estate person press 2.  Not me, I pressed 3 for escalation of REO.  We will see.  Another wait.... OOPS voice recording... your call was unable to be completed, please hang up and call the toll free number again.  I guess none of the choices applied to me. I think choice one was for finding REO properties, again I wouldn't' buy a foreclosed home unless deeply desperate.

No thanks,  this is part of what my problem of dealing with Banks has been.  transfer, wait, transfer wait and a huge cell phone bill later!   Good Luck with your calls. If you are not evicted yet, then you will have a much better experience than me. :)

"GMAC’s initial disclosures prompted challenges or investigations from attorneys general in Iowa, Illinois, Colorado, California and North Carolina. The Treasury Department, which became the majority owner of GMAC after providing $17 billion in bailout money, has directed the lender to correct its procedures.

The pressure on the lender, which began as the auto financing arm of General Motors, is continuing to increase. Senator Al Franken, Democrat of Minnesota, asked Wednesday for the Treasury, the Justice Department and other regulators to collaborate on “a thorough investigation into the alleged misconduct.”

Defense lawyers have consistently complained that the lenders’ law firms were sending through cases that were at best sloppy. The Florida attorney general’s office says it is investigating four so-called foreclosure mills."

A B C's of Fighting Foreclosure Fraud




With the current GMAC debacle of foreclosure fraud hitting the news, I thought it would be good information to show what our pro se groups have been doing for months.   Many are still not in court but they have their evidence ready.... what about you? WE also file the documentation of fraud into the county recorder's office.

How to go about stopping the FRAUD






Step 1; Gather the evidence.
            A}         Get Your papers in order.
                        1)         Original Loan documents from the closing.
                        2)         All documents [certified copies] from the county recorder’s office                                                   pertaining to the property.  Make copies for the exams and evidence.
            B}         Make copies available to 2 forensic examiners.  [2 witnesses]
                        1)         Have the loan documents examined.
                        2)         Have everything regarding the foreclosure examined.
                                    a)         Received in the mail.
                                    b)         From the county recorder’s office
                        3)         Have the SEC violations uncovered by the exam noted.
Step 2; Evidence the fraud with documentation.
            A}         Take to the police to file charges.  Get copies of the report.
            B}         Take the Notary fraud to the County Atty and the State Atty offices.  File charges                          against the Notaries for false documentation to get their seal revoked to help                               everyone involved with the sham.
            C}         Take to the FBI and report it there and get a copy of their report.
Step 3; File Your suit in the Superior court.

Local news endorses self defense: Foreclosure Seminar soon

Your legal rights in foreclosure: "When home foreclosures are taken to court, many homeowners can't afford a lawyer and end up going toe-to-toe with a bank's attorney in front of a judge. Despite the disadvantage, some people do succeed in keeping their home or at least delaying eviction.

Homeowners commonly end up in court after their mortgage goes into default, the lender has auctioned the home and is ready to evict the occupants. The bank asks a judge to rule on a 'forcible detainer' which affirms the bank's right to take possession of the property.

Valley attorney Doug Rhoads says it is possible for individual homeowners to represent themselves in court, which is called 'pro se' in law terminology. 'In the initial appearance you can handle this. You might actually be able to win.'
