Video news: I was in modification and they foreclosed without notice! Channel 12

I sat in court and watched as several people  in just one of the many courtrooms in Maricopa county said to the judge:   I was modifying my loan, I had no idea they were foreclosing.   This is a common theme.  Some even have letters showing the promise to not foreclose while modifying.   Banks do and will tell some customers that a short sale attempt will not stop foreclosure but they do not always tell customers they are at risk of losing home even with modification.

It is criminal to sit in court and people taking time off from jobs (which are hard to replace) are told they have to come back later for a hearing (with or without lawyer) to show anything they might have to prove the foreclosure was illegal   So not only are banks illegally obtaining homes by fraud, not working with the government to modify loans  they are also PRESUMED to have done everything correctly by the courts.  Given all the news reports I think any judge that PRESUMES  BANKS TO BE OPERATING CORRECTLY ARE not capable of judging.

We need over-site of government, banks and court procedures. The story above of MIKE is all to common. The comments by the Treasury is ASTOUNDING. Don't count on Mikes eviction being held for very long. Share this article by using the tweet and facebook links in righthand column.

A B C's of Fighting Foreclosure Fraud

With the current GMAC debacle of foreclosure fraud hitting the news, I thought it would be good information to show what our pro se groups have been doing for months.   Many are still not in court but they have their evidence ready.... what about you? WE also file the documentation of fraud into the county recorder's office.

For those that are not signed up to the mortgage-challenge group or the showmetheloan.net site  here is an example of some free information available by donation.  I have related blogposts:

Referrals to the examiners and experts can be found on my referrals page.  Cindy will be your best help in the notary/signature fraud that is exemplified by the GMAC debacle.

How to go about stopping the FRAUD

Step 1; Gather the evidence.
A}         Get Your papers in order.
                        1)         Original Loan documents from the closing.
                        2)         All documents [certified copies] from the county recorder’s office                                                   pertaining to the property.  Make copies for the exams and evidence.
B}         Make copies available to 2 forensic examiners.  [2 witnesses]
                        1)         Have the loan documents examined.
                        2)         Have everything regarding the foreclosure examined.
                                    a)         Received in the mail.
                                    b)         From the county recorder’s office
                        3)         Have the SEC violations uncovered by the exam noted.
Step 2; Evidence the fraud with documentation.
A}         Take to the police to file charges.  Get copies of the report.
B}         Take the Notary fraud to the County Atty and the State Atty offices.  File charges                          against the Notaries for false documentation to get their seal revoked to help                               everyone involved with the sham.
C}         Take to the FBI and report it there and get a copy of their report.
Step 3; File Your suit in the Superior court.

If you need more information on filing suit... join these groups, form a local support team and learn or hire a lawyer. Research carefully and get practice practice practice.

Where is Perry Mason when you need him?

Okay... so you (like me) are out of funds and  think that lawyer fees would be reasonable.  They are reasonable if you are sucessful. BUT, the problem is that while fighting foreclosure most people are bankrupt, or have no jobs and have used up savings.   So do you have 5-10K for a retainer?

In the old days; when I watched Perry Mason, he would accept a $1.00 bill from potential client in distress and represent him/her.  Of course he had all the time in the world and never lost a case that I remember.

Today, fast foward about 60 - 70 years later and many lawyers have been burned.  Which makes it harder to take on needy clients.  Some will work pro bono but they can't take ALL pro bono cases.  We have some great lawyers here and most are doing all they can to help, while still keeping their staff, office rent and lifestyles afloat.

There are scam groups out there that will chisel 3K from people and then charge a huge fee if they win your house and they are not lawyers just people "helping".  These groups might take upwards to 50% of your home value and then tell you to refinance and pay up!    Is it any wonder that we are in the mess we are in today.  Those groups are no different than the conglomerate banks who seem to be greedy and non helpful to their customers. Foreclosing without warning while "modifing" a loan that was a toxic loan to begin with.  but I ramble on .

You can go pro, se and represent yourself, which is very hard work and takes a learning curve.  As for me, I am Pro Se while looking for a  Perry Mason type, who could smooth talk the court.  I could answer his phones and give him $1.00. Last I read about 60% of those going through a foreclosure fight are representing themselves, mostly due to funds, but some because they do not trust lawyers to fight like the homeowner does.

Enjoy this clip of the full Perry Mason theme song.

I have a dream - that someday all foreclosure will be reversed

Okay, the title got you right?   Well that dream is true and I am working hard with others to make it a reality! There so many people from the "Show me the Loan" group,  the auditors, lawyers, bankruptcy help group and other groups -   fighting  the rampant fraud across America. .  Hopefully by having up to date news, support groups, information share and referrals to expert help that "gets it" - we will be one step closer to reversal of all mortgage fraud and wrongful foreclosures.

I have a twitwall and it is very useful for some things.  IN it I can promote articles that you all like and that are helpful to others.  I can track responses and group topics.

This week I noticed that the articles I thought would be the most popular such as "Donald Trump and The Apprentice Talk Recession" or "Real Housewives Talk Foreclosure" - well those were not the most popular topics.  I put together a report gathered from stats on the blog and on shortening links as well as responses from twitter.  To me it was very surprising.   People are hungry for news. Especially if that news is affecting their personal live right now.

Here are the 5 most visited blogposts by page view -  visited this last week!  They were not necessarily the ones that earned the most money, but apparently they were the most useful to people.

$1 billion nationwide: NPS foreclosure damage grant

»  byLeonardini

Maryland foreclosures: State to get $6.8 million to help stabilize neighborhoods damaged by foreclosures - baltimoresun.com: "Maryland communities will receive $6.8 million to combat the damage that foreclosures have wreaked in neighborhoods, the federal government said Wednesday.

The grants are part of $970 million the U.S. Department of Housing and Urban Development is handing out nationally"   Additional locations receiving help include:

St. Louis REgion (including Illionois)  with award of  $16.2 million    this is in addition to the previous 14+ million awarded in previous years. Illinois will recieve $30 million

Oregon will receive funds. $5 million on top  two previous awards of  $19.6 million and $6.8 million. The state has used those awards to acquire more than 350 properties for rehab or resale in 45 communities including Portland, Gresham, Salem and Bend.

Nevada  who leads in foreclosures nationwide; expects $43 million to help with foreclosure
 crisis..

Florida  200 million.. .what is slap in the face -  where was  all the help for homeowners whose modifications were never considered and were not helped. Those who were evicted and yet now look at what is said:

"These homes are going to be the primary residence of those who are working hard during these difficult times, yet are still struggling to own their own home," Brown said. "Additionally, the program puts people to work immediately since many of the homes require renovation."

NOTE:  What about the over 1 million people yearly nationwide that were trying to stay in their homes?

JUST OUT: -  ARIZONA gets help:

Arizona to receive $45 million more to fight foreclosure crisis

AZ Central.com - Lynh Bui - ‎1 hour ago‎
8, 2010 01:14 PM Arizona will receive an additional $45 million in federal dollars to help with the state'sforeclosure crisis. Arizona counties, cities and ...

  ROBINHOOD:  STATES IN

TIGHTS?

WASHINGTON (MarketWatch) -- The U.S. Housing and Urban Development Department on Wednesday allocated $1 billion in funding to U.S. states to help stabilize neighborhoods faced with many foreclosures. The sweeping bank reform bill, the Dodd-Frank Act, allocated the funds for the programs. "These grants will support local efforts to reverse the effects these foreclosed properties have on their surrounding neighborhoods," said HUD Secretary Shaun Donovan. States can use the funds to acquire land and property; demolish or rehabilitate abandoned properties.

NOTE:  Read that bold part again... States  can now take advantage of homeowners who has their homes stolen (see florida) by illegal foreclosure mills etc.   Doesn't that just make your brown eyes - blue?  Let's see conflict of interest.... help homeowners?  or help grow cities or state lands?  Dont' staes make laws that affect the homeowners ability to win or lose their foreclosure fight in court?

NOTE:  the ultimate slap in face is evicting homeowners, especially those trying to get help, and then allowing THEIR tax dollars to help fund recovery for the aftermath of foreclosure frenzy

I could go on and on, but it is getting pretty disgusting to listen to ALL the taxpayer money being awarded, when this was PREVENTABLE.   Dont' get me wrong I think neighborhoods need cleaning up and crime preventation and restoration BUT I am sick at heart that states, cities, banks and insurance companies get funding and homeowners get the boot.

Save your home from foreclosure listings: steps

Please retweet this blogpost if you find it helpful in learning about government mortgage homeownership and bank loan modifications

Don't let your home become a statistic of the bank - listed on their FORECLOSURE LISTINGS.

This is not legal advice and it is not going to save your home on its own. YOU have to do a few things to have any chance of stopping a foreclosure. Do not allow your home to be sold out from under you - start as early as you can with these steps to increase your knowledge and ability to either represent your self or talk to lawyers and other professionals. There are so many scams out there and being organized helps keep you calm and focused.

START a notebook with all your documentation. Their notices AND envelopes in clear plastic in a notebook will help keep you organized.

SCAN all documents into computer. Thanks to Darrell yesterday I picked up a great tip to organize in folder on computer by MONTH/DAY/YEAR 12/05/1997

Get Loan and Foreclosure Documents examination. (see my pages for referrals or talk to people in groups for names of trustworthy examiners and/or lawyers)

Recorded Documents: Request in person or download every document on file by the state from online. Make sure you get them all, check any co-owner records also. Take pictures of your property periodically.

Go to the courts: If you are fighting foreclosure yourself or even if you have a lawyer - go to the courts and WATCH. Sit and listen and get familiar with how things operate. Do this even if you are not set to go to court. This may be useful even if you are only negotiating with banks. Do not let your house become prey to the foreclosure lists.

READ all you can and take your vitamins, exercise and pick up your mail. Get a copy of JurisDictionary course (even if you have to buy it) and learn about court procedures. Read about how to object .

Join Groups or Start Groups that fight foreclosure and exchange information and support each other at court. Get brave, do not be ashamed. One out of SEVEN in America are in your shoes; including celebrities and millionaires and even housing authorities, you are not alone.

DOCUMENT EXAMINATION: Get Loan and Foreclosure Documents examined. (see my referral pages) OOPS said it 2x. Must be a reason. OH YES, It is that important.

Attend a Seminar if possible. Labor Day Weekend is Show Me The Loan ($275 donation) and Sept 15th is free informational seminar (same place and time as last time). Hope to see you there. This is video link to a preview of one of the speakers on Labor Day - Bill McAffrey.

How the Other Side Sees Us Livinglies's Weblog

How the Other Side Sees Us Livinglies's Weblog: "s a Pro Se, I have learned that reading appellate decisions about how claims fail is very instructive (even if it isn’t a foreclosure case). What you may soon learn is that you can lose right at the beginning (to borrow from Neil’s admonition to win at the beginning).
• Most pro se litigants know just enough procedure to kill their cases from the get go and even a skilled attorney brought in later can’t fix what was broken.
• Many attorneys write crappy pleadings and were a complete waste of money for their client.
• You have to put in the very long hours at a real law library. Find your state/federal causes of action reference texts and learn the rules of what you have to plead – or should plead – in your complaint or answer."

Lowest Home Ownership Rates since 1960's

Please retweet this blogpost if you find it helpful in learning about government mortgage homeownership and bank loan modifications

Watching today's news coverage and reading the USA Today's article about the drop in homeownerhip; several things became apparent. The prediction of my realtor friends and dire warnings of the housing depression was mild compared to today's estimates....

6 MILLION - repeat 6 Million out of 8 million homeowners lagging in payments now will ultimately lose their homes to foreclosure.

Face it most Americans love owning their own home and until recently it has been a great financial decision to own a home, less expensive than renting and a matter of pride...But now; not only are some people are afraid to buy, the banking industry is making it harder to qualify for a home, and the government is not addressing the actual unemployment rate in a real and substantive way.

Things need to turn around fast to help protect our neighborhoods and communities.

Right now in our local city you can buy a foreclosed home for between 50 and 100 thousand..... There are bargains out there, but be careful because there are also many homeowners that having been evicted may be suing the bank and trying to get their home back... not the money the home. Remember that many evicted wrongfully have homes that have sentimental value. This promises to be another mess coming down the pike for those that buy without checking title or ignoring problems with title.

According to this Prisonplane Blog :

"About 18.9 million homes in the U.S. stood empty during the second quarter as surging foreclosures helped push ownership to the lowest level in a decade.

The number of vacant properties, including foreclosures, residences for sale and vacation homes, rose from 18.6 million in the year-earlier quarter, the U.S. Census Bureau said in a report today. The ownership rate, meaning households that own their own residence, was 66.9 percent, the lowest since 1999."

If you have read my previous blogposts; you will see that I think fraud has much to do with this foreclosure crisis, housing market crisis, or as some term it, blight on our local communities. Whatever the name for it, there are solutions for your situation. People need to stand up and fight for their homes and for reforms in banking and government.
